Terms
The plain version of what you are buying. Pens Down is a product of Emsden Studio (ABN 71 729 409 987), in Queensland, Australia.
What you get
Each week we email your venue a trivia pack: questions and answers, a host booklet, a TV show, a phone answer page and printable sheets. Packs arrive by 9am Monday, Brisbane time.
The licence
- Each pack is licensed to one venue: the venue named on your subscription. On the group plan, each venue you pay for is licensed.
- You can run the pack as many times as you like inside that venue, and keep it after your subscription ends for use at that venue.
- You cannot rebroadcast or stream the night, run it online, sell or share the pack, or pass it to another venue or host company.
- The questions, script, sheets and designs remain ours. Facts are free; our wording and packs are not.
Price and payment
A$99 a month per venue, or the group rate shown on the pricing page, in Australian dollars. Emsden Studio is not registered for GST, so no GST is charged. Payment is taken monthly by card through Stripe.
Free first night
Your first 7 days are free. We take your card at sign-up and charge it for the first time after 7 days. Cancel before then and you are not charged. If you sign up from a link in an email where we already sent you a free night, there is no second free period: your first month is charged at sign-up, and the sign-up page says so before you pay.
Refunds
If you are not happy, ask within 7 days of your first monthly charge and we refund that charge in full. After that, payments are not refunded, but you can cancel at any time and you will not be charged again. If a pack is late or broken, tell us and we will fix it or credit you.
Cancelling
Cancel any time from the account link in every email. There is no lock-in. You keep receiving packs until the end of the month you have paid for.
Accuracy
We check every answer against a saved source before it ships. Mistakes still happen. If you find one, reply to any pack email and we will check it and correct the pack. Our liability for a wrong answer is limited to fixing it or refunding that month. Nothing in these terms limits your rights under the Australian Consumer Law.
Music and images
We do not send audio. If you play music at your venue, that is covered by your venue's own music licence, not ours. Picture round images are our own, public domain or openly licensed, with credits in the pack.
Prizes and the league
Prizes for a night at a venue are chosen, funded and handed out by the venue running it: typically a bar voucher or a meal. The national league is coming soon and is not running yet. When it opens, any prizes for league against league placings will be announced then, with their own rules, and are not promised now. We do not collect entry fees, hold or pool any money, or run a draw. Placings are decided by trivia scores, which is a game of skill, not chance, and entry to the night is free of any purchase we require, so no trade promotion lottery permit is needed for the league as we run it. A venue that adds a paid entry, a pooled cash prize or a random draw is responsible for checking its own state's rules.
Changes
If we change the price or these terms we will email you at least 30 days before it applies to you, and you can cancel before then.
